Appeals Court Stays Vaccine Mandate on Larger Businesses

A federal appeals court on Saturday temporarily halted the Biden administration’s vaccine requirement for businesses with 100 or more workers.
The 5th U.S. Circuit Court of Appeals granted an emergency stay of the requirement by the federal Occupational Safety and Health Administration that those workers be vaccinated by Jan. 4 or face mask requirements and weekly tests.
Louisiana Attorney General Jeff Landry said the action stops Democratic President Joe Biden “from moving forward with his unlawful overreach.”
“The president will not impose medical procedures on the American people without the checks and balances afforded by the constitution,” said a statement from Landry, a Republican.

Such circuit decisions normally apply to states within a district — Mississippi, Louisiana and Texas, in this case — but Landry said the language employed by the judges gave the decision a national scope.

Company That Paid Largest Health Care Fraud Penalty in History Claims Its New COVID Drug Cuts Hospitalization, Death by 85%

American pharmaceutical giant Pfizer Inc. and its subsidiary Pharmacia & Upjohn Company Inc. (hereinafter together “Pfizer”) have agreed to pay $2.3 billion, the largest health care fraud settlement in the history of the Department of Justice, to resolve criminal and civil liability arising from the illegal promotion of certain pharmaceutical products, the Justice Department announced today.
Pharmacia & Upjohn Company has agreed to plead guilty to a felony violation of the Food, Drug and Cosmetic Act for misbranding Bextra with the intent to defraud or mislead. Bextra is an anti-inflammatory drug that Pfizer pulled from the market in 2005. Under the provisions of the Food, Drug and Cosmetic Act, a company must specify the intended uses of a product in its new drug application to FDA. Once approved, the drug may not be marketed or promoted for so-called “off-label” uses – i.e., any use not specified in an application and approved by FDA. Pfizer promoted the sale of Bextra for several uses and dosages that the FDA specifically declined to approve due to safety concerns. The company will pay a criminal fine of $1.195 billion, the largest criminal fine ever imposed in the United States for any matter. Pharmacia & Upjohn will also forfeit $105 million, for a total criminal resolution of $1.3 billion.
In addition, Pfizer has agreed to pay $1 billion to resolve allegations under the civil False Claims Act that the company illegally promoted four drugs – Bextra; Geodon, an anti-psychotic drug; Zyvox, an antibiotic; and Lyrica, an anti-epileptic drug – and caused false claims to be submitted to government health care programs for uses that were not medically accepted indications and therefore not covered by those programs. The civil settlement also resolves allegations that Pfizer paid kickbacks to health care providers to induce them to prescribe these, as well as other, drugs.

Pfizer’s oral COVID-19 antiviral Paxlovid has cut the risk of hospitalization or death by 85% in a late-phase trial, prompting the Big Pharma to stop the study and race to seek emergency use authorization from the FDA.

Pfizer’s phase 2/3 trial randomized non-hospitalized adult COVID-19 patients who were at high risk of progressing to severe illness to receive placebo or Paxlovid, a combination of the protease inhibitors PF-07321332 and ritonavir. The efficacy analysis is based on 1,219 patients.
There were six hospitalizations and no deaths among the 607 patients who received Paxlovid within five days of symptom onset, compared to 41 hospitalizations and 10 deaths in the placebo cohort. The rates of hospitalization or death in the Paxlovid and control arms were 1% and 6.7%, respectively, resulting in a risk reduction of 85%.
DeSantis Announces Lawsuit Against Biden’s ‘Unconstitutional’ Employer Vaccine Mandate

Florida Gov. Ron DeSantis announced on Nov. 4 that he is suing the Biden administration over its “unconstitutional” employer vaccine mandate being issued through the Occupational Safety and Health Administration (OSHA).

The governor said the vaccine mandate will drastically impact Florida companies, both public and private, who receive millions of dollars in federal contracts annually.
“We started with 15 days to slow the spread and now it’s get jabbed or lose your job. We’re supposed to be a government of laws, not a government of men. This OSHA rule is 500 pages of a government of bureaucracy, a government that is being run by executive edict, not a government bound by constitutional constraints,” said DeSantis in a statement.
“The State of Florida will immediately challenge the OSHA rule in court because it’s inconsistent with the Constitution and not legally authorized through Congressional statutes. There is no federal police power and the federal government cannot unilaterally impose medical policy under the guise of workplace regulation. Individuals should make informed choices about their own healthcare. It is important to stand up for people’s individual ability to make decisions for themselves. And the practical result is that this is going to exacerbate a lot of the existing problems that we are seeing with the economy,” DeSantis said.
Thousands of Intel Officers Refusing Vaccine Risk Dismissal

Thousands of intelligence officers could soon face dismissal for failing to comply with the U.S. government’s vaccine mandate, leading some Republican lawmakers to raise concerns about removing employees from agencies critical to national security.
Several intelligence agencies had at least 20% of their workforce unvaccinated as of late October, said U.S. Rep. Chris Stewart, a Utah Republican who is a member of the House Intelligence Committee. Some agencies in the 18-member intelligence community had as much as 40% of their workforce unvaccinated, Stewart said, citing information the administration has provided to the committee but not released publicly. He declined to identify the agencies because full information on vaccination rates was classified.
5-Year-Olds Will Soon Have to Show Vaccine Cards in San Francisco

San Francisco will soon require children as young as 5 to show proof of Covid-19 vaccination to enter certain indoor public spaces like restaurants, entertainment venues and sporting events, public health officials said this week.
The local mandate already requires children and adults over the age of 12 to show proof that they are vaccinated before entering those places. Now, city health officials are planning to extend the health order to children ages 5 to 11, the group newly eligible for the shot.
